Designatic, LLC, doing business as 1MinuteReel.com ("1MinuteReel", "we", "us", "our"), a Colorado limited liability company, operates the website 1minutereel.com and the 1MinuteReel application (the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our Service.

1. Information We Collect

Account information. When you create an account, we collect your name, email address, and authentication credentials through our authentication provider (PropelAuth).

Payment information. Payment processing is handled by third-party processors. We do not store credit card numbers or bank account details on our servers.

Content you create. Video recordings, scripts, outlines, captions, and other content you create using the Service. Video processing (recording, editing, captioning) happens in your browser. Exported videos may be stored on our servers for publishing and storage purposes.

Usage data. We collect standard usage information such as pages visited, features used, browser type, device type, and IP address.

Connected platform credentials. When you connect social media accounts (e.g., YouTube, Instagram, TikTok, Facebook, LinkedIn, X) for publishing, we store OAuth access tokens provided by those platforms. These tokens allow us to publish content on your behalf. We do not store your social media passwords.

Advertising and analytics tracking. On our marketing website (1minutereel.com), we use the Meta (Facebook) Pixel to measure the effectiveness of our advertising and understand how visitors interact with our site. The Meta Pixel collects information such as pages visited, buttons clicked, device type, browser type, IP address, and referral source. This data is shared with Meta Platforms, Inc. and may be used by Meta to deliver targeted advertising on Facebook and Instagram. The Meta Pixel is only activated after you provide consent via our cookie banner.

Cookies and local storage. We use browser local storage to save your preferences and session data. We use essential cookies for authentication. The Meta Pixel sets third-party cookies for advertising and analytics purposes. You can control non-essential cookies through our cookie consent banner or your browser settings.

2. Legal Basis for Processing (GDPR)

If you are located in the EU/EEA, we process your personal data under the following legal bases:

  • Contract performance. Processing your account information, content, and payment data is necessary to provide the Service you subscribed to.
  • Legitimate interest. We process usage data and analytics to improve the Service, detect fraud, and ensure security. You may object to processing based on legitimate interest by contacting us.
  • Consent. For non-essential tracking (such as the Meta Pixel for advertising analytics) and connecting third-party social media accounts for publishing, we rely on your explicit consent. You may withdraw consent at any time by adjusting your cookie preferences or disconnecting platforms.
  • Legal obligation. We may process data to comply with applicable laws, such as responding to law enforcement requests or tax obligations.

3. How We Use Your Information

  • To provide, operate, and maintain the Service
  • To process your transactions and manage your subscription
  • To store and deliver your video content
  • To publish your videos to connected social media platforms on your behalf
  • To communicate with you about your account, updates, and support requests
  • To improve and develop new features
  • To detect and prevent fraud or abuse

4. How We Share Your Information

We do not sell your personal information. We may share information with:

  • Service providers. Cloud hosting (Cloudflare), authentication (PropelAuth), payment processing, and analytics providers that help us operate the Service.
  • Advertising partners. With your consent, the Meta (Facebook) Pixel shares browsing data with Meta Platforms, Inc. for advertising measurement and optimization. You can opt out at any time via our cookie consent banner.
  • Social media platforms. When you choose to publish videos, we share your content and associated metadata with the platforms you select (e.g., YouTube, Instagram, TikTok, Facebook, LinkedIn, X).
  • Legal requirements. If required by law, subpoena, or other legal process, or to protect the safety of our users or the public.

5. Data Storage and Security

Your data is stored on Cloudflare's global network (R2 storage and D1 database). Video processing occurs client-side in your browser. We use industry-standard security measures including encryption in transit (TLS) and at rest.

6. Data Breach Notification

In the event of a data breach that compromises your personal information, we will notify affected users within 72 hours of becoming aware of the breach, as required by GDPR and applicable US state laws. Notification will be sent via email to the address associated with your account and will include: the nature of the breach, the types of data affected, the steps we are taking in response, and recommended actions you can take to protect yourself.

We will also notify relevant supervisory authorities as required by law.

7. Your Rights

You may:

  • Access, update, or delete your account information at any time
  • Delete your videos and content from our servers
  • Export your data
  • Close your account by contacting us

If you are in the EU/EEA, you have additional rights under GDPR including the right to data portability, restriction of processing, objection to processing based on legitimate interest, and the right to lodge a complaint with a supervisory authority.

8. California Privacy Rights (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

  • Right to know. You can request a summary of the personal information we have collected about you, the categories of sources, and the purpose for collecting it.
  • Right to delete. You can request that we delete the personal information we have collected about you, subject to certain exceptions.
  • Right to opt out of sale/sharing. We do not sell your personal information. The Meta Pixel may constitute "sharing" of personal information under CCPA for cross-context behavioral advertising purposes. You may opt out of this sharing by declining cookies via our consent banner or by contacting us.
  • Right to non-discrimination. We will not discriminate against you for exercising any of your CCPA rights.

To exercise these rights, contact us at [email protected]. We will respond to verifiable requests within 45 days.

9. Do Not Track

Some browsers include a "Do Not Track" (DNT) signal. There is currently no industry standard for how companies should respond to DNT signals. We do not currently respond to DNT signals. However, our cookie consent banner allows you to control non-essential tracking, and the Meta Pixel is only activated with your explicit consent.

10. International Data Transfers

Our Service uses Cloudflare's global network for hosting, storage, and content delivery. Your data may be processed and stored in data centers located outside your country of residence, including in the United States. By using the Service, you consent to the transfer of your data to these locations.

We rely on Cloudflare's data processing agreements and standard contractual clauses to ensure appropriate safeguards are in place for international transfers of personal data from the EU/EEA.

11. Data Retention

We retain your account data for as long as your account is active. When you delete content or close your account, we remove your data from our servers within 30 days. Some data may be retained in backups for up to 90 days.

12. Children's Privacy

The Service is not intended for users under 16 years of age. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16, we will take steps to delete that information promptly.

13. Third-Party Links

The Service may contain links to third-party websites and services. We are not responsible for the privacy practices of those third parties.

14. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on this page, updating the effective date, and sending an email to the address associated with your account.
