Terms & Conditions

These Terms and Conditions ("Terms") govern your use of 1minutereel.com and the 1MinuteReel application (the "Service") operated by Designatic, LLC, doing business as 1MinuteReel.com ("1MinuteReel", "we", "us", "our"), a Colorado limited liability company. By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this requirement.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use.

Required information. When creating an account, you must provide accurate and complete information, including your name and email address. You agree to keep your account information current and accurate.

3. Subscription and Payment

Access to the Service requires a paid subscription. We offer a monthly plan ($149/month) and an annual plan ($1,490/year). The monthly plan includes a 7-day free trial with a credit card required at signup. If you do not cancel before the trial ends, your card will be charged automatically. Annual subscribers receive a discounted rate (pay for 10 months, get 12). The first 100 annual subscribers receive Founders pricing, which is locked for life as long as the subscription remains active. By subscribing, you agree to pay the applicable fees. Subscriptions renew automatically unless cancelled before the renewal date.

If you cancel and later resubscribe, the current price at the time of resubscription will apply.

7-day free trial. New monthly subscribers receive a 7-day free trial beginning on the date of signup. During the trial, you have full access to all features. If you cancel before the trial ends, you will not be charged. If you do not cancel, your subscription will automatically convert to a paid monthly subscription at $149/month.

Free workshops. Live workshop sessions are free to attend for everyone, regardless of subscription status. Workshop recordings may be purchased separately ($47 one-time) or are included with an active paid subscription.

Team seats. Paid subscribers may add team members to their account. Each team member occupies a subscriber slot and is billed at the current subscription price at the time they are added. Team member pricing is grandfathered for life, the same as any individual subscriber.

We reserve the right to change pricing for new subscribers at any time. Existing subscribers will receive 30 days' notice before any price change applies to their renewal.

4. Refund Policy

4.1 Renewal Refunds. If you did not intend to renew, you have 7 days after your renewal date to request a full refund of that renewal charge. After 7 days, renewal charges are non-refundable. You may cancel at any time to prevent future renewals.

4.2 How to Request a Refund. To request any refund under this Section, contact us at [email protected] with your account email and the reason for your request. Refunds will be processed to your original payment method within 10 business days of approval.

4.3 Fraud Prevention. We reserve the right to deny refund requests that we reasonably believe involve fraudulent activity, including but not limited to: multiple accounts created by the same individual or household, or any other activity intended to exploit the refund policy rather than genuinely use the Service.

5. Your Content

Ownership. You retain all rights to the content you create using the Service, including videos, scripts, outlines, and captions.

License to us. You grant us a limited license to store, process, and transmit your content solely to provide the Service (e.g., hosting your videos, publishing to platforms you select). This license terminates when you delete your content or close your account.

Marketing license. By publishing content through the Service, you grant Designatic, LLC a non-exclusive, royalty-free, worldwide license to feature, share, repost, embed, and display your published videos and associated content (such as captions and thumbnails) for marketing, promotional, and educational purposes. This includes sharing on our social media accounts, website, advertising, case studies, and presentations. We will credit you by name or handle when reasonably possible. This marketing license survives termination of your account for content we have already shared, but we will not use new content after you close your account.

Opt out. You may opt out of the marketing license at any time by contacting us at [email protected]. We will remove your content from our marketing materials within 30 days of receiving your request. Opting out does not affect the Service license above.

Visual attribution. During the free trial period, all exported videos include a "Made with 1MinuteReel.com" visual attribution burned into the video. This attribution cannot be removed, hidden, or obscured during the trial. The visual attribution is automatically removed upon activation of a paid subscription. Attempting to remove, cover, or alter the attribution during the trial is a violation of these Terms.

Responsibility. You are solely responsible for the content you create and publish. You agree not to use the Service to create or distribute content that is illegal, infringing, defamatory, or harmful.

6. Publishing to Third-Party Platforms

When you publish videos through the Service, you authorize us to submit your content to the platforms you select using the account credentials (OAuth tokens) you provide. You are responsible for complying with each platform's terms of service and community guidelines. We are not responsible for how third-party platforms handle your content after publication.

You may disconnect any connected platform at any time, which revokes our ability to publish to that account.

FTC disclosure. If you create sponsored, paid, or affiliate content, you are solely responsible for including appropriate disclosures as required by the Federal Trade Commission (FTC) and any applicable advertising laws. 1MinuteReel does not monitor or enforce advertising disclosure requirements on your behalf.

7. Platform Analytics and Community Insights

Individual analytics. When you connect social media accounts to the Service, we may retrieve performance metrics for content you publish through the Service. This includes views, likes, comments, shares, watch time, completion rates, and other engagement data provided by each platform's API. We use this data to show you how your content is performing and to help you improve your content strategy.

Community benchmarks. We may aggregate and anonymize performance data from across our user base to generate community-level insights and benchmarks. These benchmarks help all users understand how their content compares to similar content on the platform. Aggregated data is always anonymized — no individual user, account, or video can be identified from community benchmarks.

Examples of community insights include: average views by reel type, best-performing hook styles, optimal posting times, and engagement benchmarks by industry or topic.

Opt out of community benchmarks. You may opt out of contributing your performance data to community benchmarks at any time through your account settings in the app. Opting out means your data will not be included in any aggregated insights shared with other users. You will still have full access to your own individual analytics and can still view community benchmarks generated from other users' data.

Platform compliance. We collect and use platform analytics data in accordance with each platform's developer terms and API policies. When you disconnect a platform or revoke access, we will stop collecting new data from that platform and delete stored analytics data from that platform within 30 days, as required by applicable platform terms (including the YouTube API Services Terms of Service).

No sale of analytics data. We do not sell individual or aggregated analytics data to third parties. Community benchmarks are used solely within the Service to benefit our users.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that infringes on intellectual property rights
  • Attempt to interfere with or disrupt the Service
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Use automated tools to access the Service without our permission
  • Resell or redistribute the Service without authorization

9. Prohibited Content

You may not use the Service to create, store, or distribute content that contains:

  • Nudity, pornography, sexually explicit material, or adult content of any kind
  • Content that sexualizes or exploits minors in any way (CSAM). We report all suspected CSAM to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement
  • Graphic violence, gore, or content that glorifies violence
  • Hate speech, harassment, bullying, threats, or content that promotes discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
  • Terrorism, extremism, or content that promotes radicalization
  • Doxxing, stalking, or sharing private personal information without consent
  • Fraud, scams, phishing, deceptive schemes, or misleading health/financial claims
  • Impersonation of other individuals, brands, or organizations
  • Spam, unsolicited bulk content, or manipulation of platform algorithms
  • Illegal drugs, controlled substances, or content promoting illegal drug use
  • Weapons sales, instructions for creating weapons or explosives
  • Malware, viruses, or content designed to harm devices or networks
  • Deepfakes or manipulated media intended to deceive
  • Content that violates any applicable law or regulation

We reserve the right to remove any content that violates these restrictions and to suspend or terminate accounts that repeatedly or egregiously violate this policy, without refund. Violations may be reported without prior notice.

10. Law Enforcement and Reporting

We cooperate with law enforcement agencies and regulatory authorities when required by law or when we believe in good faith that disclosure is necessary to protect the safety of our users or the public. This includes responding to valid legal requests such as subpoenas, court orders, and search warrants.

We may disclose account information and content to law enforcement without notice to you when we believe there is an imminent risk of serious physical harm or death, or in cases involving the exploitation of minors.

We may also proactively report illegal activity discovered on our platform to the appropriate authorities.

11. AI-Generated Content

The Service uses AI to generate outlines, suggest scripts, and assist with content creation. AI-generated suggestions are provided as starting points only.

No warranty on AI output. We do not guarantee the accuracy, completeness, originality, or appropriateness of any AI-generated content. AI output may contain errors, inaccuracies, biased language, or content that could be considered offensive or defamatory. You are solely responsible for reviewing, editing, and approving all AI-generated content before using or publishing it.

1MinuteReel shall not be liable for any claims, damages, or losses arising from your use of AI-generated content, including but not limited to defamation, copyright infringement, or misleading statements contained in AI output that you publish.

12. Storage

Your subscription includes a base storage allocation. Additional storage can be purchased as annual add-ons. If your subscription expires and you exceed the free storage limit, we will retain your files for 30 days before deletion.

13. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Designatic, LLC and protected by intellectual property laws. Your subscription grants you a non-exclusive, non-transferable license to use the Service for its intended purpose.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that published videos will meet specific platform requirements.

15. Limitation of Liability

To the maximum extent permitted by law, Designatic, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, business opportunities, or goodwill. Our total aggregate liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

16. DMCA and Copyright Infringement

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe content on our Service infringes your copyright, submit a takedown notice to our designated agent at [email protected] with the following information:

  • Identification of the copyrighted work you claim has been infringed
  • Identification of the infringing content and its location on our Service
  • Your contact information (name, address, phone number, email)
  • A statement that you have a good faith belief the use is not authorized by the copyright owner
  • A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
  • Your physical or electronic signature

We will investigate valid notices and remove infringing content promptly. Users who repeatedly infringe copyrights will have their accounts terminated.

17. Indemnification

You agree to indemnify, defend, and hold harmless Designatic, LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) content you create, publish, or distribute through the Service; (c) your violation of these Terms; or (d) your violation of any third-party rights, including intellectual property or privacy rights.

18. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control. This includes, but is not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, internet outages, failures of third-party infrastructure providers (including Cloudflare, cloud hosting, and CDN services), social media platform outages or API changes, power failures, cyberattacks, and labor disputes.

19. Termination

You may cancel your subscription at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases. We will retain your data for 30 days after termination to allow you to export your content.

20. Dispute Resolution and Arbitration

Mandatory arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the State of Colorado, or at a location mutually agreed upon by the parties. The arbitrator's decision shall be final and binding.

Class action waiver. You agree that any disputes will be resolved on an individual basis only. You waive your right to participate in a class action, class arbitration, or any other representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative or class proceeding.

Exceptions. Either party may bring claims in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

Opt-out. You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of creating your account. If you opt out, disputes will be resolved in the state or federal courts located in Colorado.

21. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will: (a) update the version number and effective date at the top of this page, (b) notify you via email to the address associated with your account, and (c) require you to acknowledge and accept the updated Terms on your next login to the Service before continuing to use it.

By continuing to access or use the Service after updated Terms become effective, you agree to be bound by the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may request a refund in accordance with our Refund Policy.

22. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. To the extent litigation is permitted under these Terms, the exclusive jurisdiction and venue shall be the state and federal courts located in Colorado.

23. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Designatic, LLC.

24. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law. Any permitted assignment will be binding on successors.

25. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Designatic, LLC regarding the Service, and supersede any prior agreements or understandings.
